EIKI Limited Product Warranty

Eiki International, Inc. (“Eiki”) warrants to the original purchaser and/or original end-use purchaser that, for the periods set forth below starting from the date of sale to the original Purchaser, that the product (the “Product”) will be reasonably free of defects in materials and workmanship, subject to the limitations set forth below.

Extended warranty periods only apply to specific Products which are sold under express “extended warranty” terms in specified promotions.

DOA Policy.  During the first 30 days of the applicable warranty period, if the Product has a substantial defect that renders the Product essentially nonfunctional (“DOA”), Eiki will exercise commercially reasonable efforts to replace such Product, provided that the Purchaser  provides proof of purchase, and the DOA Product is returned in its original packaging with accessories, and that Purchaser has an RMA number obtained from Eiki during such thirty day period.  In the case of replacement, Eiki may keep the returned Product. If Eiki determines that the Product is free of defects, Eiki may charge purchaser the diagnose fee, handling and freight and return the Product to Purchaser at Purchaser’s cost.

General Limited Warranty Thereafter, during the applicable warranty period, Eiki will, at its option, repair or replace Products without charge, or refund the cost of the Product, if the Product fails or does perform as warranted solely due to a manufacturing defect within the applicable warranty period, subject to the exclusions set forth in this Limited Warranty. Repair or replacement during the applicable warranty period shall include reasonable labor charges necessary to repair or replace the defective product, but shall not include the costs associated with removal, repair or replacement of fixtures, hardware, or decorative treatment, including, but not limited to floor, wall, or ceiling treatments. Any repaired or replaced product shall also remain subject to the original applicable warranty period from the date of the original purchase, and any repair or replacement shall not extend the original warranty period in any manner or start a new warranty period. Shipping damages must be reported withing seven business days of receipt of the Product.  Eiki is not responsible for shipping damage reported after such period.

Warranty Process.  Coverage under this Limited Warranty is conditioned upon Purchaser by providing Eiki with proof of purchase, and providing relevant information (such as name and address, a description of the Product involved, the nature of the defect). Customer Service Center will then issue a Return Merchandise Authorization (“RMA”) number to be used as a means of identifying the product returned. RMA authorization numbers are valid for thirty (30) days and void thereafter.  Warranty service may be dependent upon Purchaser/End User having completed the Warranty Product Registration Form and at the Eiki International Website: www.eiki.com.

Disclaimer of Warranties.  Eiki’s Products must be stored, handled, installed, used, and maintained in accordance with instructions provided by Eiki.  This Limited Warranty is conditioned upon compliance with all such instructions.

This limited warranty does not extend to any Product not purchased from Eiki or an  Eiki authorized reseller. This limited warranty also does not extend to any product that has been damaged or rendered defective (a) due to normal wear and tear; (b) as a result of use of the Product other than for its normal intended use, or other misuse, abuse or negligence to the Product; (c) by the use of parts not manufactured or sold by Eiki; (d) by modification of the Product; (e) as a result of service by anyone other than Eiki or an Eiki authorized service provider; (f) improper transportation or packing when returning the Product to Eiki or an Eiki Authorized Service Provider; (g) improper installation of third-party products; (h) improper environment (including improper temperature or humidity); (i) unusual physical or electrical stress or interference, failure or fluctuation of electrical power, lightning, static electricity or similar; (j) non-compliance with Eiki’s use guide, care guide, or instruction manuals, as applicable; and (k) damages cause by fire, flooding, natural disaster, etc.

THE WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES MADE BY Eiki IN CONNECTION WITH THESE PRODUCTS. COMPANY CAN NOT AND DOES NOT MAKE ANY IMPLIED OR EXPRESS WARRANTIES WITH RESPECT TO THE PRODUCT, AND DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. COMPANY’S SOLE OBLIGATION UNDER THIS WARRANTY SHALL BE REPAIR OR REPLACEMENT OF NON-CONFORMING PRODUCTS, OR AT THE OPTION OF COMPANY, RETURN OF THE PRODUCT AND A REFUND OF THE PURCHASE PRICE. PURCHASER ASSUMES ALL RISK WHATSOEVER AS TO THE RESULT OF THE USE OF THE PRODUCTS PURCHASED, WHETHER USED SINGULARLY OR IN COMBINATION WITH ANY OTHER PRODUCTS OR SUBSTANCES.

Limitation of Liability. 

No claim by the Purchaser/End User of any kind, including claims for indemnification, shall be greater in amount than the purchase price of the Products in respect to which damages are claimed. COMPANY SHALL NOT BE LIABLE TO PURCHASER/END USER IN TORT, CONTRACT OR OTHERWISE, FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, RELIANCE, STATUTORY, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE, LOSS OF TIME, LOSS OF REVENUES, INCONVENIENCE, LOSS BUSINESS OPPORTUNITIES, DAMAGE TO GOOD WILL OR REPUTATION, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN, IN CONNECTION WITH, ARISING OUT OF, OR AS A RESULT OF, THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS SOLD HEREUNDER, OR FOR ANY LIABILITY OF BUYER TO ANY THIRD PARTY WITH RESPECT THERETO. COMPANY IS NOT RESPONSIBLE FOR DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SUCH LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH MAY VARY FROM STATE TO STATE

Any dispute arising out of or related to this warranty shall be resolved in the state or federal courts located in Orange County, California.
